In Alabama you have 5 years from the date of death to file a Will for probate. There can be limited exceptions to this based on local Court rules and the consent of heirs at law.

Therre is no such thing as a Will that does not have to be probated. The sole purpose of making a Will is to one day probate that Will. The probate process makes the things set out in the Will actually happen. If all the property and assets mentioned in a Will had already been sold or transferred then the probate of the Will would serve no purpose.
