If you ignore it, will it go away?  Many people take this approach to making a Will.  They seem to have the mindset of ” If I don’t make a plan for this then it will never happen.”  Of course, that just isn’t the case.  It is something that we all must face eventually.  So that brings us to the question of ” What happens if I do not have a Will?”

For everyone who has not made a Will, the legislature of the State of Alabama has, as most, if not all states have done in one form or another, in effect “made a Will” for you.  There is a set of statutes known as the Laws of Intestate Succession.  These Statutes set out to whom and in what percentage your estate, and all of it’s assets will be distributed.  So you see, it can’t be avoided.  You only have one choice to make.   That choice is, “Do you want the government to decide for you who will get your assets and how they are to be distributed OR do you want to make your own decisions?”

Most people when given a choice between making their own decision or having the government make it for them will choose to make their own decision.  The only way to do that is to make a will.
